This notice provides information about how your data is collected and processed.

In the context of business relationships with our existing customers and/or relations with potential customers, Atlantic Financial Group (hereinafter “AFG”) collects and processes personal and financial data about you in order to offer you financial and banking products and services tailored to your needs and your profile or in response to your requests. We also process personal data based on your use of our website, particular via the various forms available on the site.

The personal data obtained is collected directly from you and based on documents obtained by your intermediary, as well as from public registers, intermediaries ensuring data accuracy, as well as any legitimate third-party sources. It is processed and recorded by AFG as data controller.

AFG attaches great importance to protecting your data. By continuing to use this site or establishing a business relationship with us, you explicitly agree to our data processing and confidentiality policies.

Type of data

In principle, AFG does not process data outside the framework of its business relationships with its customers. Nevertheless, due to legal or regulatory provisions, AFG may need to process data outside of contractual relationships.

Depending on the financial  services concerned, AFG needs to collect, use, retain and/or transfer your personal data, as well as data on any joint account holders, card-holders and commercial partners you may have (including other shareholders or economic beneficiaries), members of your family, representatives or proxies.

The information collected includes:

  • personal information (such as last name, first name, data of birth, passport, telephone, home address, postal/email address and telephone number),
  • family information;
  • financial information including statements, transactions, real-estate property, debts, taxes, income, profits and investments;
  • tax information (particularly TIN, tax no., tax residence);
  • professional details (such as CV, experience and professional activity);
  • information linked to our interactions with you (whether via the website, contact forms, telephone calls, or visits).

We may need to record and monitor your telephone conversations with AFG in order to maintain a high level of quality as well as security in accordance with applicable regulatory and legal obligations.

Legal grounds and purpose of processing

AFG processes data to ensure correct provision of the services it needs to perform in accordance with its contractual obligations and compliance with its legal obligations or regulatory instructions, as well as the companies legitimate interests.

We collect and process your data for legal reasons and for the following purposes, as required:

  • to conclude or perform a contract to which you are party and to fulfil our obligations under such a contract;
  • to provide you with financial products and services and ensure their proper performance;
  • to manage your business relationship with us;
  • to comply with legal or regulatory obligations (particularly with anti-money laundering law, FINMA (Switzerland), AMF (France) and CCAF (Monaco) regulations and ordinances and circulars, tax legislation, market legislation concerning financial instruments) or in the public interest;
  • to carry out any form of cooperation or account reporting in respect of competent public authorities or administrations, such as criminal, tax or regulatory authorities;
  • to guarantee our legitimate interests (e.g. to establish, exercise or defend our rights in the event of disputes);

  • to use data for marketing and advertising purposes following your registration or request;
  • to analyse and monitor users’ behaviour and browsing while using electronic services.

Collection of your personal data and retention period

We retain your personal data for as long as necessary to fulfil our contractual and legal obligations. We may process and retain your data after the end of our relationship for operational purposes and/or in accordance with applicable laws, as well as pursuant to various legal and regulatory obligations in relation to retention and documentation.

Use of the website

Contact Form: this data is collected in order to be able to contact you and send you offers linked to the AFG product range. This data is retained until you inform us that you no longer wish to be contacted by us.

We therefore collect information enabling us to identify and contact you, such as: last name, first name, email, home address, telephone number, your investor profile and the company you work for. When making contact, additional information may be requested, such as an address or your job title.

Employment Form: this data is collected in order to be able to contact you and check whether your profile matches our criteria. In the absence of a favourable response from us, we retain your personal data for a limited amount of time in order to be able to re-contact you if we have any further job offers.

We therefore collect information enabling us to identify and contact you, such as: last name, first name, email, home address, telephone number and current employer.

Your rights

In line with applicable regulations, you have a right to access the personal data we have collected about you, as well as a right to rectify personal data you have sent us. You may also withdraw your consent at any time. Nevertheless, withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent before it was withdrawn. You may object to processing, ask for data to be deleted or its processing to be restricted or, where relevant, you may request a copy of your personal data, within the limits and under the conditions stipulated by applicable legislation and regulations.

In the event that we use your data for direct marketing purposes, particularly to send a newsletter, you have the right to object to the processing of your personal data at any time. In that case, we shall no longer process your personal data for that purpose.

The above-mentioned rights may be suspended or limited when third parties’ interests, rights or freedoms prevail or when processing of the data is required to invoke, exercise or protect claims by AFG. Furthermore, AFG is authorised to suspend or limit the above-mentioned rights if the data is processed in the framework of its activity as stipulated by law or regulations. In the context of exercising of some of the above-mentioned rights, particularly the rights to object to or restrict data processing, AFG may no longer be able to provide you with certain financial or banking products or services, or even continue a business relationship.

Communication of your personal data

AFG is subject to confidentiality obligations when processing personal data.

In the context of performance of our services, personal data may be transmitted to third parties. The recipients of that data may be banks participating in the transaction, banking correspondents, trading platforms, brokers, stock markets, systems operators, transfer registration, clearing, processing and stock market reporting services, issuers, fund and private equity administrators, sub-custodians, local market or regulatory authorities, as well as other third parties involved in providing transactions or services. Furthermore, AFG may need to provide information to authorities and/or third parties if obliged by applicable legal provisions.

When AFG outsources certain services, and insofar as personal data needs to be communicated to suppliers or service providers, it requires them to undertake to comply with all data protection and confidentiality obligations with which it complies itself, to ensure that your data remains secure.

The data collected via this site may be transmitted to various entities in the AFG Group within the European Union and in Switzerland.

Confidentiality of your personal data

AFG takes all technical and organisational necessary measures to ensure the security and confidentiality of personal data.

We restrict access to your personal information to those employees, agents or third parties which need to know it in order to provide you with products or services, relating to your investments made by us directly or as an intermediary. We provide physical, electronic and procedural protection to preserve your personal information, particularly including a firewall, encryption, personal passwords and authentication technology.

All the personal information supplied via this website shall be processed confidentially, in accordance with applicable legislation and regulations.

Nevertheless, despite the precautions in place, users of this site explicitly accept that the internet is not a secure means of communicating information and that they use the internet at their own risk. AFG declines all liability for any loss or damage that could result from interception by third parties of any information made available to you via this site. AFG declines all liability, in particular, for any loss or damage caused by the breakdown or interruption of this site, or an error, omission, interruption, deletion, fault, delay in functioning or transmission, an IT virus, a fault or alteration in the communication channel, even if the circumstances which led to the incident are within the control of AFG or of any service or software support provider.
